Terms and Conditions 

Our tours are run for you by a small team who love sharing the knowledge and creative corners of our beautiful area, Byron Bay. Please read the info below so you know the fine print and your responsibilities. 

‘We wish to recognise the generations of the local Aboriginal people of the Bundjalung Nation who have lived in and derived their physical and spiritual needs from the forests, rivers, lakes and streams of this beautiful valley over many thousands of years as the traditional owners and custodians of these lands. We ask that you help look after and respect Country. We pay our respects and gratitude to the indigenous Elders past, present and emerging’.

       

By booking a tour with Eco Lane Byron Bay you are accepting these Terms and Conditions as a binding contract without alteration, unless otherwise stipulated by Eco Lane management. Eco Lane Byron Bay reserves the right to update or alter these Terms and Conditions at any time, and it is the guest's responsibility to be familiar with them. The latest Terms and Conditions can always be found on the website ecolane.com.au and will supersede any previous versions. 

 

  • We’, ‘us’ or ‘our’ refers to Eco Lane provider.

  • ‘Participant’ or 'guest' refers to the person who has booked and/or paid for the tour.

Respect of the land, our hosts & our tour guides

At all times the decision of the Eco Lane Byron Bay tour leader or representative will be final on all matters likely to affect the safety and well-being of the tour from the time the tour is booked to run.  This includes any decision that the tour leader makes about the on-going participation of a guest on the tour or certain activities that comprise part of the tour. This includes any person, in the opinion of the tour leader, who is affected by alcohol or other drugs (whether prescribed by a medical practitioner or otherwise). We will be walking on some private, so public land. During the time the tour is running, each guest will be expected to be respectful and considerate of the property, land and premises we visit. 

If a guest fails to comply with, or have a reasonable discussion about a issue raised by the tour leader, or interferes with the well-being of the group, premises host or other guests or people of the public, then the tour leader reserves the right to terminate this contract and order the guest to leave the tour immediately, with no right of refund. The matter may be also reported to the NSW Police if deemed necessary by the Eco Lane Byron Bay tour leader or representative.

 

Cancellations or Changes by Participants/Guests

Eco Lane Byron Bay has the following cancellation policy:

  • Bookings requested to be cancelled less than 2 weeks before the tour will not receive a refund, but may be credited to a later date. 

  • Bookings cancelled more than two weeks before the tour will have the full tour price refunded. 

 

Cancellations or Changes by Eco Lane Byron Bay 

Our walking tours require a minimum of  4 guests to commence. If the minimum number is not reached then Eco Lane Byron Bay reserves the right to change or cancel any bookings. Eco Lane Byron Bay  reserves the right to cancel or vary this service in any way without notice. However, reasonable effort will be made to maintain arrangements as advertised.

Eco Lane Byron Bay will not proceed should we decide that the weather makes the participation in the tour unsafe, or for any other reason, at our absolute discretion.  If we cancel a tour we will endeavour to do one of the following:

  • Re-book you for another date or tour (subject to availability)

  • Transfer your booking to another person

  • Provide a gift voucher for the specific tour

There will be no refund of a ticket by Eco Lane Byron Bay except in accordance with these terms or as agreed in writing by us. Refunds will only be made to the person who purchased the ticket from Eco Lane Byron Bay. 

Refunds

Refunds will be processed within 14 days of the agreement by Eco Lane Byron Bay. 

Self responsibility  

All Participants acknowledge and agree that they participate in Eco Lane Byron Bay tours at their own risk. All Participants are required to take reasonable steps to ensure their own personal safety on public and private land, and comply with New South Wales laws. Please practice common sense, awareness of others and due diligence.

All participants will be required to disclose to their Eco Lane Byron Bay guide prior to the commencement of all tours whether the participant experiences any medical condition which may prevent or affect the participant undertaking the tour. This includes but is not limited to limb or back injury, heart conditions, severe asthma, epilepsy, dizziness, or recovering from recent surgery. Our aim is to minimise risk for all participants. 

Timing & Itinerary

You will need to arrive 10 minutes prior to our departure time.  As we will have one guide on each tour, Eco Lane Byron Bay will not be able to contact you by mobile phone if you are late or missing part of the tour. However, if you do contact us we may be able to advise where the first stop is so you can join the tour a little late. 

We accept no responsibility for, and provide no refund for, participants who miss any part of the tour for any reason. 

We reserve the right to alter any part of the itinerary without notice before or during the tour as circumstances dictate. We will endeavour to communicate any significant changes in a timely manner but are not liable for any changes and are not required to offer any refunds as a result of any change.

Bookings

Tickets must be paid for at the time of booking via our website. We may charge a booking fee or credit card transaction fee when paying for tickets. Tickets are non-refundable and are only valid for the booked tour unless given express written consent by Eco Lane Byron Bay.  It is not requested to print your ticket. 

Pricing

All prices are quoted in Australian dollars (AUD). All prices on our website supersede all prices previously advertised. Booking fees for credit card transactions are not refundable. We reserve the right to increase or decrease advertised prices for our tours at any time.

Gift Vouchers

  • Gift vouchers are valid for 12 months from the date of purchase.

  • Gift vouchers are valid for the tour specified on the gift voucher only.

  • Gift vouchers are not redeemable for cash and are non-refundable.

  • Gift vouchers will not be replaced or refunded if lost or redeemed by someone other than the intended recipient.

  • Gift vouchers are not valid with any other special offer or package.

  • Gift vouchers can be purchased online through our booking system and redeemed through the link provided on the gift voucher email using the voucher code provided.

Private & Corporate Tours

Eco Lane Byron Bay  is available for private tours, corporate walking tours and other special events. Please contact us for more information. Any quotes provided are valid for 28 days from the date on the quote. The full amount quoted is required at the time of booking unless otherwise agreed by Eco Lane Byron Bay. If a private or corporate booking is cancelled by you:

  • Between day of tour and 30 days before the tour – no refund

  • More than 30 days before the tour – 50% refund.

Special requests by guests during the private and corporate tours are subject to agreement by the tour guide. If the tour goes over the allocated time due to the private groups request or need, an additional charge of $50 will be invoiced. 

Last Minute Deals

From time to time discounted tours may be offered by Eco Lane Byron Bay  as last minute deals. Discounted tours require full payment immediately on booking. The number of places on discounted tours is subject to availability. Any discount does not apply to existing bookings and cannot be used with any other discounts. Prices are per person per tour and are subject to availability. Discount applies to selected tours only. Eco Lane Byron Bay reserves the right to discontinue the promotion at any time without notice.

Access 

Eco Lane Byron Bay welcomes passengers with disabilities and access needs on our small group walking tours, including people using wheelchairs or needing a support person. Please contact us at least 48 hours ahead of your tour to discuss your support or access needs, and we will chat about which tour is best accessible for you. Our regular tours average 1-3km per hour and participants must be able to cover these distances. Please feel welcome to call and discuss. 

Age restrictions

Persons under the age of 10 years need to be confirmed & may accompany their guardian for free. Children 11 and over need to have a ticket.   All children need to be kept safe, respect the guides instructions and be accompanied at all times. Any tours with the option to purchase alcohol will not accept under 18 years guests. 

Safety

We strongly recommend wearing comfortable closed shoes on all our tours for occupational health and safety reasons. Wearing sun protective hat and reef safe sunscreen is highly recommended and you are welcome to bring a small umbrella for sun or rain protection.

By booking with us you acknowledge that participation in all our tours involves minor inherent risks that you are responsible for your own wellbeing and safety.

Service of Alcohol

Eco Lane Byron Bay does not condone excessive or binge drinking. We promote responsible drinking of alcohol. Guests must at all times abide by state and federal laws regarding lawful drinking practices including, but not limited to, Responsible Service of Alcohol (RSA) laws, the consumption of alcohol in public places and consumption of ‘bring your own’ (BYO) alcohol. Service of alcohol may be refused to persons deemed intoxicated. Cuisine and Beverages  walking tour visits licensed premises where alcohol is served it is your responsibility to carry a valid passport, drivers licence, proof of age card, or other suitable form of identification for the duration of the tour.

Any guest who consumes, or is suspected of consuming, alcohol in a non-licensed area can be removed from the tour. They will not be entitled to any refund. Non-licensed areas may include, but are not limited to: non-licensed venues, BYO drinks on venue properties; or any public areas such as footpaths, restrooms, or parks.

Behaviour

Eco Lane Byron Bay walking tours and local experiences are friendly, low key events, and we expect responsible, respectful behaviour from our participants. Participants are responsible for any damage they cause during the tour to property any cafes, galleries, bars or businesses we visit.

Participants must behave respectfully toward others on the tour and anyone else they meet along the way. Any person deemed unruly or disruptive can be removed from the tour and will not be entitled to any refund. Disrespectful behaviour will not be tolerated on the tours. There is no consumption of alcohol on any tour other than the Cuisine and Beverage trail. 

Any legal action (including fines) taken against a person on the tour, or against Eco Lane Byron Bay because of the actions of a participant, will be the sole responsibility of that person or persons. We are not responsible for the conduct of third party operators, venues or suppliers.

 

Publicity

Eco Lane Byron Bay may ask your permission to use images or video of you taken during the tour. You are welcome to decline to have photos taken, if you agree we may use the images or video without recourse to you and without compensation to you, for publicity and promotion purposes only, through whatever medium we choose.

Privacy

Eco Lane Byron Bay will need to collect some information from you, some of which may be of a personal nature, in order to provide a service. The information may be disclosed to, or collected on our behalf by our service providers to enable the services to be provided, but will not be used by them for any other purpose.
 

Guest Release and Eco Lane Byron Bay Liability

Utmost care and attention will be taken by our guides and hosts to ensure the enjoyment and safety of each participant.  However, by purchasing a ticket and agreeing to the terms and conditions, each participant releases Eco Lane Byron Bay, its employees and agents from liability or loss or injury to the guest from any cause, and whether due to the negligence of Eco Lane Byron Bay or any other person. Each participant releases Eco Lane Byron Bay from all sums of money, accounts, claims, actions, proceedings, demands and expenses which the guest at any time may have against Eco Lane Byron Bay for or by reason or in respect of any act, cause, matter or thing. Each guest indemnifies Eco Lane Byron Bay against:

  • All losses incurred by Eco Lane Byron Bay

  • All liabilities incurred by Eco Lane Byron Bay; and

  • All costs actually payable by Eco Lane Byron Bay  to its own legal representatives (whether or not under a costs agreement) and other expenses incurred by Eco Lane Byron Bay in connection with a demand, action, arbitration or other proceeding (including mediation, compromise, out of court settlement or appeal); arising directly or indirectly as a result of or in connection with any act or omission of the guest.

Booking Agents Liability

If a Booking Agent sells any tickets or vouchers on behalf of Eco Lane Byron Bay, the Booking Agent indemnifies Eco Lane Byron Bay against:

  • All losses incurred by Eco Lane Byron Bay

  • All liabilities incurred by Eco Lane Byron Bay

  • All costs actually payable by Eco Lane Byron Bay to its own legal representatives (whether or not under a costs agreement) and other expenses incurred by Eco Lane Byron Bay in connection with a demand, action, arbitration or other proceeding (including mediation, compromise, out of court settlement or appeal); arising directly or indirectly as a result of or in connection with any acts or omissions of the Booking Agent.

Discretion

Eco Lane Byron Bay may use its absolute discretion in exercising any of the rights granted to it pursuant to these Terms and Conditions.

Governing Law and Jurisdiction 

The law of NSW governs these Standard Terms and Conditions. The parties submit to the non-exclusive jurisdiction of the courts of NSW and of the Commonwealth of Australia.
